1. Scope of Services

CyberEngine AI provides B2B custom AI automation engineering, Voice AI and CRM workflow integration, Operational Diagnostic Audits, and Executive Coaching & Fractional CAIO Advisory services:

1. Every Diagnostic Audit reviews your existing software stack, lead response speed, CRM handoffs, and operational bottlenecks to deliver a written architecture roadmap and fixed-price build scope.
2. Every Fixed-Price Custom Automation Build covers end-to-end engineering, API connections, testing, and launch across your designated accounts (including CRM, phone/Voice AI, calendar, project management, and billing platforms), governed by a written Statement of Work (SOW).
3. Executive Coaching and Fractional CAIO Advisory engagements are delivered either through our 8-week cohort program (AI Leadership Mastermind) or an ongoing monthly retainer (Scale & Autonomy Advisory).

2. Fixed-Price Billing, Retainers & Third-Party Software Costs

• Custom automation builds and Diagnostic Audits are billed according to the flat fee and milestone schedule written in your Statement of Work or checkout invoice.
• Ongoing advisory retainers and optional maintenance plans are billed in advance on a monthly or quarterly schedule as agreed in writing.
• Because CyberEngine AI builds automations directly inside your own cloud accounts, you remain responsible for keeping active subscriptions and usage balances with your chosen third-party software vendors (such as OpenAI, Anthropic, Twilio, Vapi, Retell AI, HubSpot, GoHighLevel, Make, n8n, or Stripe).
• All quoted fees exclude applicable federal, state, or local taxes, levies, or duties imposed by taxing authorities.

3. Client Ownership, Intellectual Property & Handoff

1. Once full payment for a custom automation build is received, you own 100% of the deployed workflows, custom webhook configurations, prompt templates, and operating documentation built for your business accounts, with no platform lock-in.
2. We claim no ownership over your private business data, CRM records, SOPs, or customer lists, and all credentials shared during a project are accessed under strict least-privilege security controls.

4. Client Responsibilities & Regulatory Compliance

1. You must be at least 18 years old and authorized to bind your organization to engage our services.
2. When running automated voice, SMS, or outbound email workflows built by CyberEngine AI, you are responsible for keeping your outreach practices compliant with applicable telecom and privacy laws in your jurisdiction, including the Telephone Consumer Protection Act (TCPA), A2P 10DLC carrier registration rules, CAN-SPAM, HIPAA, and GDPR where applicable.
3. You may not use any workflow, script, or system delivered by CyberEngine AI to send unlawful spam, deceptive messages, or malicious code.

5. SMS Communications & Appointment Notifications

When you submit a form on cyberengineai.com and opt in to receive SMS notifications from Top Gun Holdings CO / CyberEngine AI:

• You consent to receive automated and manual text messages related to your inquiry, appointment confirmations, diagnostic audit updates, and requested follow-ups.
• Message and data rates may apply depending on your mobile carrier plan, and message frequency varies based on your interactions.
• You may opt out of SMS communications at any time by replying STOP to any message, or reply HELP for assistance.

6. Warranties, Limitation of Liability & Governing Law

1. While CyberEngine AI tests all custom workflows before handoff and provides post-launch support as defined in your SOW, we cannot guarantee uninterrupted uptime of third-party software APIs, telecom carriers, or AI model providers outside of our control.
2. To the maximum extent permitted by law, Top Gun Holdings CO and CyberEngine AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business interruption, arising out of your use of this website or any third-party software connection.
3. These Terms and any dispute arising from your use of the website or our services are governed by the laws of the State of Florida, with venue in Miami-Dade County, Florida.
